1.1. This public offer for making a charitable donation (hereinafter referred to as the \u201cOffer\u201d) is a proposal of an individual entrepreneur (hereinafter referred to as the \u201cBeneficiary\u201d) addressed to an indefinite number of legally capable individuals and legal entities of private law who voluntarily carry out charitable activities (hereinafter each such person referred to as the \u201cDonor\u201d) to conclude an agreement on making a charitable donation (hereinafter referred to as the \u201cAgreement\u201d) on the terms described in this Offer with each Donor who applies.<\/p>\n\n\n\n
1.2. This Offer is an offer to conclude an agreement in accordance with Article 641 of the Civil Code of Ukraine.<\/p>\n\n\n\n
1.3. This Offer comes into force from the moment it is published on the website on the Internet at: http:\/\/donat-ua.com (hereinafter referred to as the \u201cWebsite\u201d). This Offer is open-ended and may be amended or withdrawn by the Beneficiary at any time (prior to its acceptance by the Donor) by publishing the relevant information on the Website.<\/p>\n\n\n\n
2.1. Under this Agreement, the Donor gratuitously and irrevocably transfers funds as a voluntary charitable donation into the ownership of the Beneficiary, and the Beneficiary accepts such charitable donation and undertakes to provide the Donor with souvenir products presented on the Website. All funds received by the Beneficiary in connection with the operation of the Website shall be transferred to charitable purposes.<\/p>\n\n\n\n
2.2. The transfer of funds by the Donor under this Agreement is recognized as a charitable donation in accordance with Article 6 of the Law of Ukraine \u201cOn Charitable Activities and Charitable Organizations\u201d.<\/p>\n\n\n\n
2.3. The Donor independently determines the amount of the charitable donation. The Donor has the right to request from the Beneficiary and receive information about the nature and amount of the charitable assistance required for specific charitable organizations to which the assistance will be transferred.<\/p>\n\n\n\n
2.4. The conclusion and performance of this Agreement are not intended to and do not provide for the receipt of profit by any of the parties.<\/p>\n\n\n\n
3.1. The Donor independently determines the amount of the charitable donation and makes it by (i) carrying out a monetary transfer using the payment forms and means posted on the Website. Charitable donations are not limited in time, and the period of their use by the Beneficiary is not limited.<\/p>\n\n\n\n
3.2. When making a donation, for the proper identification of the payer, the Donor provides their contact information: first and last name, name of the legal entity, email address and\/or phone number, other data enabling identification of the Donor, as well as other information.<\/p>\n\n\n\n
3.3. Acceptance of the Offer shall be deemed its full and unconditional acceptance by the Donor through performing actions to transfer the charitable donation funds to the Beneficiary by one of the methods specified in the Offer. The Offer shall be deemed accepted and the Agreement concluded from the date the funds are credited to the Beneficiary\u2019s current account.<\/p>\n\n\n\n
3.4. By accepting the Offer, the Donor confirms that they agree with all the terms of the Offer, fully understand and agree with the subject matter and terms of the Agreement.<\/p>\n\n\n\n
3.5. The Beneficiary sends or otherwise transfers, by any available means, souvenir products to the Donor as a token of gratitude for the charitable assistance provided.<\/p>\n\n\n\n
3.6. Expenses related to making charitable donations (fees for transferring funds, taxes, charges, etc.) shall be borne by the Donor if such expenses are charged to the Donor, and by the Beneficiary if such expenses are charged to the Beneficiary. The Donor understands and agrees that part of their charitable donation may be used by the Beneficiary to cover expenses related to making charitable donations if such expenses are charged by third parties by default and cannot be avoided (for example, payment system acquiring fees, bank fees, etc.).<\/p>\n\n\n\n
4.1. The Beneficiary undertakes to transfer all funds received in connection with the operation of the Website to charitable purposes.<\/p>\n\n\n\n
4.2. The Beneficiary has the right to independently choose the charitable organizations to which the funds received in connection with the operation of the Website will be transferred.<\/p>\n\n\n\n
4.3. By making a charitable donation, the Donor unconditionally confirms their legal capacity, the voluntary nature of entering into the transaction, that the subject of the charitable donation is not prohibited, seized, pledged, encumbered by any other rights of third parties, and was not acquired in violation of the provisions of the Law of Ukraine No. 361-IX \u201cOn Prevention and Counteraction to Legalization (Laundering) of Proceeds from Crime, Financing of Terrorism and Financing of the Proliferation of Weapons of Mass Destruction\u201d.<\/p>\n\n\n\n
5.1. By accepting the Offer, the Donor gives consent to the Beneficiary to process their personal data disclosed by the Donor when making a charitable donation for the purpose of fulfilling the terms of the Agreement. Such personal data may include: first name, last name and patronymic, address, place of residence, email address, phone number. Permitted types of personal data processing include collection, registration, accumulation, storage, adaptation, modification, updating, use and dissemination (distribution, sale, transfer), depersonalization, and destruction. The Beneficiary undertakes not to disclose the Donor\u2019s personal data to third parties without the Donor\u2019s consent, except in cases where such disclosure is required by state authorities or otherwise required in accordance with the legislation of Ukraine. The Donor confirms that they have been informed of the rights established by the Law of Ukraine \u201cOn Personal Data Protection\u201d. The scope of the Donor\u2019s rights as a personal data subject under the Law of Ukraine \u201cOn Personal Data Protection\u201d is known and understood by them.<\/p>\n\n\n\n
5.2. The Donor gives consent for their contact information to be used by the Beneficiary to send souvenir products, letters, and messages to the Donor, including electronic ones. At the same time, the Beneficiary undertakes not to provide the Donor\u2019s contact information to third parties, except in cases expressly provided for by the legislation of Ukraine.<\/p>\n\n\n\n
5.3. In the event of disputes between the parties to this Agreement, they shall be resolved through negotiations. If a negotiated settlement is not possible, disputes shall be considered by the courts in accordance with the procedure established by law.<\/p>\n\n\n\n
